Use of the following terms
Right of withdrawal – the right of the consumer to unilaterally withdraw from the contract (reject the order) within a certain period of time, without paying a contractual penalty, interest or damages.
The right of withdrawal, the procedure and the deadline for realizing the right of withdrawal are determined by the Law on the Protection of Consumer Rights and the Regulations of the Cabinet of Ministers of May 20, 2014 No. 255 "Regulations on a distance contract" (hereinafter - Regulations on a distance contract).
Prices – the prices of the relevant goods indicated in the online store, for which the Seller offers them for purchase.
Internet store – a website maintained by the Seller, which is located at the Internet address www.imeitech.lv and through which it is possible to purchase the goods offered by the Seller.
Order payment day – the day when the Seller has received payment in full for the goods specified in the order in his current account.
Consumer - a natural person who expresses a desire to purchase, purchases or could purchase or use a product or service for a purpose that is not related to his economic or professional activity.
Seller – limited liability company IMEI, single registration number 40203558381, legal address: Rīgas iela 14-6. Ikšikile, Ogre county, LV-5042.
Buyer - a person who places an order for goods in the Internet store. The buyer can be both a Consumer and a person who is not a Consumer.
Shopping cart – the items selected by the buyer in the online store.
Parties – Buyer and Seller.
Operation of the Rules
The Terms determine the legal relationship between the Buyer and the Seller.
In addition to these provisions, the legal relations of the Parties are determined by the Civil Code, the Commercial Code, the Law on the Protection of Consumer Rights and other regulatory acts of the Republic of Latvia.
The provisions of the Law on the Protection of Consumer Rights and other legal acts regulating consumer rights are not applicable to the legal relationship between the Seller and the Buyer who is not a Consumer.
The confirmation of the order, which specifies the specific goods and their price, is considered a part of the contract concluded between the Parties.
The seller has the right to change and supplement these terms. Changes in these terms and conditions came into effect from the moment of their publication on the website www.imeitech.lv, and they apply to product orders made after the publication of the changes.
Product description and prices
Product characteristics, specifications and prices are indicated in the online store in the selection window of each relevant product. If necessary, additional information about the product can be obtained by writing to atbalsts@imeitech.lv
The Product Prices are valid in case of timely payment, that is, when payment is made in accordance with article “Payment procedure”
Prices are inclusive of all taxes. The price does not include the cost of delivery.
Assortment of items and prices may be changed without prior notice. The changes come into effect from the moment of their publication on the website www.imeitech.lv, and they apply to product orders made after the publication of the changes.
Shopping cart and ordering
Information on how to purchase goods in the Internet store is located in the "Information" section of the Internet store.
The shopping cart is created by the Buyer choosing the relevant product and using the "Add to cart" menu.
To review the shopping cart, use the "Cart" button in the upper right corner of the page.
Minimum order value are 5 (five) euro.
All selected items are displayed in the shopping cart. The quantity of products in the shopping cart can be changed using the "+" and "-" menus. To continue placing the order, use the "Place order" menu.
Users registered in the "My IMEI" section can access the system by entering their e-mail address and password used for registration in the Internet store. Unregistered users should use the "Register" menu and provide the necessary information. After familiarizing yourself with the content of these rules and confirming them, use the Catalog, Cart menu to continue placing the order.
In the "Delivery info" section, you can choose the type of delivery, specify the delivery address, check and clarify the information provided above, as well as specify additional information. The delivery fee and delivery time depend on the chosen delivery method. Use the "Payment" menu to continue placing the order.
You can choose a payment method in the "Payment method" section.
The order is considered to have been placed and becomes binding for the Parties at the moment when the Seller has received the order made by the Buyer and has sent the order confirmation to the Buyer's e-mail address (or otherwise). The goods are handed over to the Buyer only after full payment of the order. The buyer has no right to receive the goods before the full payment is made.
Payment procedure
Information on the payment procedure is located in the "Payment rights" section of the Internet store.
Payment of the order is possible in one of the following ways:
via the internet bank, using the internet banking services indicated in the "Payment method" section,
by making a non-cash transfer according the invoice issued by the Seller,
with a payment card, paying online,
ESTO buying on credit,
credit comparison platform e-lizings
The order and the invoice are canceled if the invoice is not paid within 5 (five) working days from the moment it is sent to the Buyer.
Delivery procedure, delivery fee
There is a charge for the delivery of the goods, it is not included in the price of the goods. Information on the delivery of goods, including the delivery fee, is indicated in the "Delivery" section of the Internet store. Delivery is possible throughout the territory of the Republic of Latvia.
You can choose the delivery method when ordering goods in the "Delivery info" section.
The goods are delivered only if the order is fully paid for and the Seller has received payment in full for the goods and services specified in the relevant order in his current account.
Goods are delivered by courier. The goods are delivered to the address specified in the Buyer's order. The Parties shall agree on the time of delivery of the goods by telephone, by calling the Seller or the supplier (courier) of the goods to the phone specified in the order. The Buyer can contact the Seller in matters related to the delivery of goods by calling the Seller's telephone numbers (26452288) indicated in the Internet store.
After handing over the goods to the courier, the courier may contact the Buyer to clarify delivery-related information.
The maximum term of delivery of goods in the territory of the Republic of Latvia for goods that are available in the Seller's warehouse is 7 (seven) working days after the day of payment of the Order. Usually, the delivery of the Goods is carried out no later than 2 (two) working days after the day of payment of the Order, however, the delivery of the Goods within such a period is not guaranteed.
The Parties agree separately on the term of delivery of goods for goods that are not available in the Seller's warehouse, as well as on the possibility and term of delivery of goods outside the territory of the Republic of Latvia. Information on whether the relevant product is available in the Seller's warehouse is placed in the Internet store next to the relevant product. The "Add to cart" menu means that the product is available, while the "Available" menu means that the product may not be available and its availability should be checked by contacting the Seller.
If the Seller cannot fulfill the order due to the unavailability of the ordered goods, the Seller can supply the Buyer with an equivalent item at an equivalent price. If in such a case the Buyer, who is a Consumer, uses the Right of Withdrawal, the costs associated with returning the goods to the Seller shall be borne by the Seller. If the Seller does not deliver an equivalent product to the Buyer at an equivalent price, he informs the Buyer about this and refunds the entire payment made to the Buyer no later than 30 (thirty) calendar days from the day the Seller received the Buyer's order.
In order to facilitate the fastest possible delivery of goods, complete and accurate information about the delivery location (door code, floor, exact building entrance, if there are several, etc.) must be indicated. The Seller is not responsible for the delay in delivery if it is caused by incomplete or inaccurate information provided by the Buyer.
The goods are delivered with the Goods list.
Before receiving the goods, the Buyer must present an identity document (identity card or passport) or driver's license. If the Buyer is a natural person and the product is received by his authorized representative, a power of attorney issued in the form of a notarial deed must be presented. If the Buyer is a legal entity, the recipient of the goods presents documents confirming the right of representation.
Before accepting the goods and signing the delivery documents, the Buyer must check the packaging of the goods. If damage to the package or product is detected, it must be reported to the courier and a damage report must be drawn up, as well as reported to the Seller at the e-mail address atbalsts@imeitech.lv.
The buyer has the right to refuse the courier to accept a damaged shipment. The Buyer must notify the Seller of the refusal to the e-mail address atbalsts@imeitech.lv.
Information on the right of refusal and returning the product to the Seller.
The consumer has the right to use the Right of Withdrawal. The right of withdrawal can be exercised within 14 (fourteen) calendar days from the day when the Consumer or a third party other than the carrier and indicated by the consumer has received the last product.
The right of refusal can be used by submitting the "Refusal form" to the Seller, which is available here (link must be added). The use of the refusal form is not mandatory, and instead the Consumer can submit a written application to the Seller, which indicates the order number, product name, order amount, Consumer's name, personal identification number, address, phone number and details for refund. It is possible to complete the application for refusal in the "Customer information" section of the e-shop. Sending a refusal within a specified period terminates the contract and releases the Consumer from any contractual obligations, except for the costs associated with returning the goods to the Seller.
The consumer is obliged to return the product to the Seller within 14 (fourteen) days after sending the written refusal (if the product or item has been received). The Seller is obliged to immediately, no later than within 14 (fourteen) days from the date of receipt of the Consumer's written refusal, reimburse the Consumer the amount of money paid for the product up to the moment of termination of the contract. The Seller has the right not to refund the amount of money paid for the product to the Consumer until the Consumer has returned the product or has not submitted documents confirming the return of the product.
The returned product must be delivered to the OMNIVA parcel locker at the address Ogres novads, Ikškile, Daugavas prospectus 18A. If the Consumer does not have the opportunity to deliver the goods to the Seller, it is possible to order transport for the delivery of the goods from the address specified by the Consumer, which is a paid service.
The consumer is responsible for maintaining the quality and safety of the product during the period of exercising the right of withdrawal. The consumer, using the right of withdrawal, is responsible for any decrease in the value of the product, if the product has been used in a way that is incompatible with the principle of good faith, including used for a purpose other than to clarify the product's characteristics or operation.
The product to be returned must be complete.
The consumer cannot use the right of withdrawal in the cases referred to in Clause 22 of the Regulations on distance contracts, including if:
the price of the goods depends on the fluctuations of the financial market, which cannot be controlled by the Seller,
the goods are made according to the Consumer's instructions or are irreplaceable items, or for health and hygiene reasons (for example, body care and hygiene products), or are perishable or can be quickly used up,
The consumer has opened the audio recording or video recording or computer program package.
Warranty and Consumer's claim for a product that does not meet the terms of the contract
The goods offered in the online store are subject to a manufacturer's warranty, if the manufacturer offers one. The warranty period and other terms are indicated in the product description or in the warranty documents attached to the product. The guarantee does not affect the rights granted to the Consumer by regulatory enactments.
Regardless of the warranty provided by the manufacturer, the Consumer, in accordance with the requirements of the Law on the Protection of Consumer Rights and other regulatory acts, has the right to submit a claim to the manufacturer or the Seller for non-compliance of the product with the terms of the contract within 2 (two) years from the purchase of the product. The day when the manufacturer or the Seller handed over and the Consumer accepted the relevant product is considered the day of purchase of the product. Chapter VI of the Consumer Protection Law determines the procedure for applying and considering a Consumer's claim for a product that does not meet the terms of the contract.
When submitting a claim to the manufacturer or the Seller regarding non-compliance of the goods with the terms of the contract, the Consumer shall attach a copy of the transaction document to the Claim application.
Final terms
The distance contract concluded between the Buyer and the Seller enters into force at the moment when the Seller has received the order made by the Buyer and sent the order confirmation to the Buyer's e-mail address (or otherwise), and it is valid until its execution (payment and delivery of the goods), or is terminated if the invoice is not paid within 5 (five) working days from the moment it is sent to the Buyer.
The Parties are responsible for the direct damages caused to the other Party.
Information on the processing and protection of data provided by the Buyer is specified in the "Privacy Policy" section of the Internet store.
The laws of the Republic of Latvia are applied to the legal relationship of the parties. Disputes between the Parties are resolved through mutual negotiations. If the Parties fail to reach an agreement in this way, the dispute shall be considered by the judicial authorities of the Republic of Latvia. The consumer has the right to contact the Center for the Protection of Consumer Rights.
A private person receives an electronically prepared waybill that is valid without a signature.
Attention for buyers
Product assortment and prices may be changed without prior notice. Product manufacturers may change product specifications without prior notice to the Seller. Product description uses information and images provided by the manufacturer, wholesaler.
The Seller asks the Buyer to report the noticed inaccuracies in the product description or image by contacting the Seller by writing to the e-mail atbalsts@imeitech.lv.
All pictures and descriptions in the online store are placed with the aim of providing the most accurate information about the goods. The images and description of the products under consideration may differ slightly from the offered product.
